If you've been in the food service industry, for "a long time", and just now realized everything you mentioned is illegal, then you're extremely lucky to even have a job at all. I'd hold on to it if I were you, Brain Trust.
Just be glad you don't live in a state with a server's minimum (which is often like $2.50 an hour, due to the assumption that you'll live on tips, only people in states with server's minimums tend not to tip as compulsively as Oregonians).
But yeah, the fact that there is a line of 100 transplants willing to take every shitty dishwashing job the second it's available makes it reeeally easy to be taken advantage of. You want your legal breaks and pay? Too bad, the next 50 people are more desperate than you.
If you think Texas is bad you should try bartending in Alabama. No minimum wage laws so you are basically working for $2 an hour and praying to what gods may listen that you have customers who aren't total dickheads.

There's also the option of actually serving decent food at a reasonable price. Try it sometime, restaurant strawboss types.
