I don't think Wheeler and staff get legal precedences. Either that or this is 100% publicity fluff.

Judge Simon made it abundently clear he wont allow the city to exclude people because no court in the country has ever done so. Sounds almost like common sense.

I guess its possible Wheeler believes that Judge Simon will say oh for the precious Nazi Wheeler the United States court system will have to change its rules to accomodate Wheelers wishes.
