If Judge Simon, in response to a motion from Walsh, says he can't issue an advisory opinion because the City has promised not to enforce the ordinance, how in the world does the City think they can persuade him to issue an opinion in response to the City's motion? The City is going to have to enforce this thing before the court does anything about it.

This is an excellent question. They swear they have a mechanism for getting the judge to weigh in. Others have been dubious.
