After a bike has crashed, it wouldn't strike me as at all surprising if the derailleur is out of alignment, I mean, I've had to readjust mine just from it falling over, so...
The brake failure sounds more interesting, but how does a brake failure when going uphill, lead to a crash? Seems like you'd slow down, put your feet down, and then stop. But maybe I'm just weird.
(Part of the reason I'm willing to even work on my own bicycle brakes is that there are two of them. I only work on one set at a time, and then I make sure that it works for a day or two before I touch the other set.)
safety is in part the responsibility of the rider, but it is (or should be) a community effort. this is why we have bike lanes, bike boxes, traffic laws pertaining to cars and bikes, professional bike mechanics and so on. so that we can all work together.
