The judge's decision was ludicrous. It's basically saying a speed limit isn't a limit, because you can still drive faster than the speed posted on the sign, you'll just happen to get an expensive ticket and fine if you do.

A poll tax that prevents poor people from voting is voter suppression. A relocation ordinance that prevents a less wealthy landlord from raising their rents a particular amount because they can't afford the resulting draconian fees is rent control. The judge had to tie the English language down and torture it to reach his preferred conclusion.
