Yeah, people in Oregon have been convicted of ID theft for just that sort of thing. Depends on the jurisdiction and which judge you pull. Multnomah county had a case where a guy put a fake personals ad for an ex-girlfriend on craigslist (sort of like the old "For a good time, call X" graffiti) and got a prison sentence for ID theft.
