Whoever wrote this ordinance should be embarrassed. When BoJack can easily point out how it's unconstitutional with zero effort (and be correct), you shouldn't have ever submitted this for voting. The city is going to end up losing money on this whole thing before it's over.

Yeeaaah. Still nope.
3
WILL THE DEBIT OPTION REQUIRE A FEE?
4
Let's think of the whole process as performance art.

Dennis, this is a small thing I know, but the measure was approved by 62.34%, not 61%. http://web.multco.us/elections/november-20…

Also, to Graham and other readers: Just because Bogdanski claims the tax is unconstitutional doesn't make it so. One judge has already ruled in favor of the city, saying the arts tax is not a head tax: http://www.wweek.com/portland/blog-29049-j…

so wait if no one pays and the city has to spend more than 5% of the revenue trying to collect then the whole thing is invalid?
7
BoJack saying it's unconstitutional doesn't make it so. Though the fact that's it's an obvious head tax DOES.

JEFF, DOES RACC PAY YOU TO DEFEND THE TAX IN BLOG COMMENTS?

ALSO, I'M SURE YOU KNOW THIS, BUT THAT SUIT WAS SOLELY ABOUT THE BALLOT TITLE LANGUAGE, NOT THE IMPLEMENTATION OF THE TAX ITSELF.

No, Drunk, they do not. And yes, I understand the context of the last lawsuit but I thought it was interesting that the judge did take the unnecessary step of explaining in no uncertain terms that the income tax is not a head tax. Still, I understand that y'all won't be satisfied until another judge rules on that item alone.

I cannot believe this tax applies to people who make as little as 1k a year. That seems absurd to me. People voted yes on this because they trusted our officials to have it on reasonable terms. No one considers 1k an "income". And I still can't get over the fact that they didn't work out a way to have it come out of your refund. I happily voted yes on it- but this is a mess, and I fear it won't pass again without serious changes.

I'd support and vote for a an actually good Arts Tax. I voted against this tax because it was both too little money and at the same time clearly and awfully regressive. We as a community deserve better.

And now when arts people pass the hat, all kinds of people will just say, "But I paid my arts tax, why do you need more money?"

Please wait...
