One of the major barriers for cannabis is the dreaded work-based drug test, AKA the urine analysis (UA) test. Because there's no better way for an employer to say "we respect and trust our workers" than requiring you to empty your bladder into a small plastic receptacle so they can determine what you're doing in your off hours. You know, just like they do for alcohol. Oh... right.
According to the Denver Post, employers are beginning to turn a blind eye to those who test positive, or are simply removing cannabis from the list of substances for which they test. This is due in part to some historically low unemployment rates, which in some job markets (such as Colorado's) are dipping at three percent or below.
It varies from state to state, and the industry in which an applicant seeks to work in also plays a role. In Colorado, with one of the country's oldest recreational cannabis programs, employers can still fire an employee who tests positive in a UA for cannabis. Maine, which also has a recreational program, recently passed a law that prohibits employers from firing or refusing to hire someone who uses cannabis in their off hours.
The type of job can account for this decision as well. As the Post reports:
"Companies in labor-intensive industries—hoteliers and home health care providers and employers with many warehouse and assembly jobs—are most likely to drop marijuana testing. By contrast, businesses that contract with the government or that are in regulated industries, like air travel, or that have safety concerns involving machinery, are continuing marijuana tests, employment lawyers say. Federal regulations require the testing of pilots, train operators and other key transportation workers."No one wants an airline pilot doing dabs before take off, but as anyone who has ever held a warehouse, hotel, or home health care job can attest, cannabis use in the off hours can help make such work bearable. And for food service workers, during breaks is what helps keeping dishes placed on the tables, and not in drunk and abusive customer's laps.
