According to OPB: "Police confirmed Tuesday morning that Smith remains hospitalized in serious condition. A spokesperson for Multnomah County District Attorney Mike Schmidt said Smith has not been formally arrested yet because he is still in the intensive care unit."

I have no idea if that's standard operating procedure or not.
