I think the laws as far as underage sex are fine. Why is it so hard for people to understand if the person is underaged, DON'T FUCK THEM! I wish my mom would have put the 33 year old I fucked in jail when I was 17. It was consensual, but now that I'm older I see how much he took advantage of my being so much younger then he was. He was a sleaze bag and I was too young and inexperienced to see it.... Hell, at the time I didn't even know he was 33, he told me he was 25 and he looked it.. Turns out the Fucking low life loser had THREE kids from three different women! He hadn't even given me his real name and I'd known him at least three months before we had sex! I think someone older would have seen right through this piece of shit!

Any 21 year old that has sex with a 16 year old doesn't belong on probation, they belong in OSP.

Thanks, Portland Mercury, for reinforcing the things many already know - measure 11 is a blight on the state of Oregon and needs to be repealed, The Washington county District Attorney's office is the worst run and most corrupt DA's office in the state, and Judge Nachtigal is completely off her rocker specifically regarding cases where sex of any kind is involved due to the well known secret that her husband Fred is a philanderer and she uses her grudge against him as an excuse to treat men in her court unfairly.

Judge Nachtigal, please do the citizens of Washington County a favor and retire already. You'll make the same paycheck either way - PLEASE go and never come back, ever.

That blog is pretty interesting (though I had to google around a bit- why no link Mercury?) and the writer has some other interesting articles on related topics. You can sleep with 'em, but you cant' photograph them. Weird.

i absolutely agree that there needs to be a change in the law which allows for these distinctions. The law is operating under the ridiculous assumption that teenagers do not have sex. Well, they do. Alot!
i was raped of my virginity by a 20 something man when i was 14. HE is a criminal. However, every male that i had dated previously & after the rape was over the age of 18. My boyfriend when i was 15 was 19 yrs. old. The reason for this is that i was not attracted to boys my age. Their immaturity was completely repellent to me. Thankfully, i had parents who respected my right to love who i chose & knew that i was mature enough to be in long term, committed relationships with older guys. i think that the laws need to make a definite distinction bewtween the ages of the 2 parties. A 19 yr. old with a 15 yr. old actually fits perfectly with the differences in developing maturity levels between boys & girls. It is quite a different affair when the individuals involved are 15 & 30-40.

Laws should have some grounding in the reality of what is happening in a society. When the median age for a woman to start having sex is less than 16 but it is illegal until she is 18 then something is wrong with the law. What we have now is that a few unlucky people get caught and end up in a heap of trouble, but realistically most people are not waiting until they are 18 to start having sex.

The laws regarding such in this state are soo missed-used & abused depending on what county you're in (Clackamas & WA cos. being the worst).

A friend of mine, who lives in Beaverton, has been sitting in jail for that past two fucking weeks b/c his 24 yr. old vindictive ex reported that they had sex when she was 17. She's 24 NOW & she only mentioned this RECENTLY! He's only 4 years older than her - they're both in their 20's now.

But there's more to the story.

They both have two kids & HE has had court custody for most of their very young lives.

A Co worker of mines son is 17, and his girlfriend is 16 and pregnant. The two will be getting married when he turns 18 so they can still be together after the baby is born. Cases like this are why the law needs some leeway; why force marriage at such young ages? Sure a 16 year old screwing a 16 year old isn't right; and situations get worse from there. But there are legit cases where 2 people want to be together but a minor age difference (no biggie when they met) can keep them apart or put one of them in jail.

Teenagers having sex might not be "right" per`say, but there's nothing on Earth anyone can do to stop it. Think about how YOU were at that age.

All sex under the age of 18 isn't illegal. Sarah, the article lacks very important clarity. According to ORS 163.345, if the two people engaging in sexual acts are less than three years apart in age, no one can be prosecuted. The only exception to this is that if one of the people is under 15 then the person who is older can be prosecuted for sexual misconduct. (There's also an exception, I guess, in the case of certain definitions of rape and sodomy that those under 12 years old cannot consent at all or for cases of incest.) See here:

What I don't know from the statutes is what happens, eg, if two 11 year olds play doctor. Or what happens if a 15 year old and 14 year old sibling decide to do the same. Perhaps it's covered by other statutes establishing age of culpability and intent.

This law is not right, I understand kids are going to have sex it just happens that way. But young men are not all to blame, young girls are as well.
They don't have to be accountable for anything that has happened, this is a big problem with the law. You can not look into their background or even make them go to court.. Even if the guy doesn't have sex with her they get in trouble!!!This is what happened to someone I know.
Went to a party was just hanging out with a couple of girls, one starts to come on to him, they talk find he is 19 and she says they are 16. The girl start to come on to him so they go into the bed room of they get naked, the girl decides she does not want to go any farther so they quite all is good right HE DID NOT GO ANY FARTHER!!!!!
Well the next day come to find out they are run aways and they are 14. So now the state is involved, a detective comes to see this kid says he wants to talk to him at the police station, he goes down there and the detective starts to hammer on him to admit he had sex with the girl!!!!! He told him over and over they only got naked!! The girl confirmed the story, He was thrown in jail and charged a felony for sexual abuse of a miner.So now he is a sex offender? I say Bull!!!
I agree there should be a law for this but the girl should be accountable as well. In this case the girls background, she is a runaway, she was taken home and ran away again, has had sex with other guys, has got in trouble with the law, and the parents don't want to see the guys life destroyed. None of this can be used in the courts because she is a miner!!!!! SHE did not have to show up in court and she gets away with everything!!!
The guy now has to prove he is not a pervert, there is something wrong here!!! Sex offender for the rest of his life??
The article did not give enough detail on the subject, yes there are perverts out there, but there are allot of innocent kids out there who are the victim here!!!! It ruins the rest of there life.

A 21-year-old man who is sneaking past a 16-year old girl's mother in order to have sex with the girl is a FUCKING SEX OFFENDER. PERIOD. THERE IS SOMETHING GRAVELY WRONG WITH A GROWN MAN WHO CANNOT HAVE SEX WITH A GROWN WOMAN! THAT IS HOW IT IS, NO EXCUSE, NO REASONING, NO BLAH, BLAH BLAH!

It's not the point, the point IS what is the 16 year old doing with him and what kind of power trip is she getting out of it!!! Why aren't the parents stopping her from having sex with him. So BLAH< BLAH BLAH yourself!!!! It's the parents fault then, sure it's a 16 your old wagging her tail in places she shouldn't!!!!!!!
