In all this #occupy madness, I lost track of posting about the article I reported this week on the sad, unsatisfying end of the case of Kyeron Fair.

Fair was a 17-year-old North Portlander when he was arrested for his role in an armed robbery of a medical marijuana user last year—his acceptance of a plea deal this week closes the case officially. But the family is still left with its most important questions unanswered. When Fair had a mental health crisis upon entering custody, he wound up being Tasered multiple times and handcuffed to a hospital bed at OHSU for 20 days with no contact with his family besides a daily phone call. He was eventually diagnosed with bipolar disorder.

The scary thing is that, in Fair’s case, the justice system worked that way it was legally supposed to. A 1,100-page inquiry into Fair’s treatment found no criminal wrongdoing. Everyone from the jailers to the hospital staff followed legal protocol. The fact that emerges from Fair’s case is that the legal protocol is horrifying and inhumane. When a 17-year-old has a mental breakdown in custody, there must be a better way to treat them than shackles, Tasers, and cutting off family contact. A big part of this has to do with the dismantling of our mental health system—the largest providers of mental healthcare in the state are our jails and prisons. Fair’s case shows exactly why that’s a problem.

  1. Armed robber gets no sympathy. Had he not been caught, he would have continued until he was caught or shot.

    You really think he’s that redeemable, put your money where your mouth is and be his adopted big sister. When he gets out you can put him up.

    I’m also sure that I too would have a mental breakdown after I got caught and realized I had screwed up and made shit decisions.

    Fry him, the community would be better off.

  2. hard to say what really happened in these instances, and sure, cops and the hands of law are on power trips and abuse it. But “mental health crisis” sounds like he developed an acute disease, which is probably not the case; he probably reacted like shit, making things worse.

    I hope his buddies learned a lesson from this too.
    Maybe I’ve become hard hearted, but I find it difficult to have sympathy for him.

  4. Typical and predicable that the “tough-on-crime” shit talkers would chime in here. FACT is, nothing’s been PROVEN against him. Cops just came and snatched him out of school one day. He’s probably fucking innocent. But even if he were guilty, he NEVER recieved proper due process. Sure, he pleaded out, only b/c he had no decent defense and the cards were stacked against him.

    The ONLY goddamn reason Kyeron is sitting in jail now is b/c he’s poor! NOT b/c he committed any crime.

    The kid stole pot with a weapon cause he’s poor? He was charged with a crime cause he’s poor? He freaked out cause he was faced with reality and we should cry him a river, cause he’s poor? Maybe he should have sold his kicks, ipod, or fancy phone and bought a bag of weed.

    I work every day, often for jobs that others would pass up. I am poor. I would never take from another unless I was starving. Apparently young mr Sadstory was starving for tokes and took the easy way.

    If a fucking martian tried to rob me with a weapon, I’d go to deadly force without a second thought, DGIAF about their problems or experience.     Report showed that he assaulted the staff, was uncooperative, and was verbally abusive. What a fucking moron to rattle the cage when he’s in custody.
